| Significant Accomplishments |
Argued before the United States Supreme Court addressing substantial First Amendment petition clause issues and prevailing as the Court determined that the level of protection for petitions does not exceed that for speech and the press. McDonald v. Smith, 472 U.S. 479
In an oft-cited 1991 North Carolina Supreme Court case, successfully argued that the Deceptive Trade Practices Act applied to sale of residental lot. Bhatti v. Buckland, 328 N.C. 240, 400 S.E.2d 440
Successfully argued one of a pair of cases establishing the mandamus relief against counties for inadequate court facilities. Ragan v. County of Alamance, 330 N.C. 110, 408 S.E.2d 838
After a client had received two life sentences, was successful in freeing his client after arguing in the Court of Appeals and prevailing against the State's efforts to have the N.C. Supreme Court take the case. State v. Maxwell, 96 N.C.App. 19, 384 S.E.2d 553
Worked for four years as an associate defending against the largest sex descrimination case ever brought by the United States government resulting in, some years later, the employer winning every aspect of the case. See EEOC v. Sears, Roebuck and Co., 839 F.2d 302
Involved from before the lawsuit was filed, through the appellate courts, and was also on the team of North Carolina and Georgia counsel for the companion federal lawsuit resulting in changing the corporate governance structure in the largest insurance company in the state. Parsons v. Jefferson-Pilot, 333 N.C. 420, 426 S.E.2d 685
Mediated over 1000 cases, from the beginning of the Superior Court mediation program in North Carolina. While most have been in the Superior Court program for which he is certified, many have been pre-litigation and in the federal courts. Matters have included law firm divisions, business and corporate governance issues, and a wide variety of Superior Court cases.
In addition to his graduate work in higher education and three years as director of institutional research at Winston-Salem State University, represented higher education institutions in a variety of matters, including most notably being among the lawyers who represented the University of North Carolina system against the federal government in HEW (later, the Dept. of Education) v. UNC, addressing issues of academic freedom and the racial identity of various institutions in the system.
Worked for several years on the team of lawyers representing the Power Authority of the State of New York in a Nuclear Regulatory Commission shutdown proceeding involving Indian Point Nuclear Power Plants, which was successfully resolved in favor of continued operation of the plants.
